| The appellant Sri. Jino Sebastian purchased 5.80 cents of land at Edakkunni village of Trichur Corporation to build a house. The appellant is a Kottayam native and residing in Trichur as he is posted in Trichur. The building permit was obtained and the construction has been started. The 11 Kv line drawn to provide power for the Thaikkattussery Ayurveda college is rerouted as per the request of the Principal, Ayurveda college for the expansion of the college. The proposed route of the 11 Kv line was approved by the ADM. The line with ABC cable was drawn by the side of the road in front of the plot owned by the appellant. One stay wire of the post was placed inside this property without the consent. The appellant wants this stay wire is to be removed from the property. The appellant approached the CGRF and CGRF issued order vide order dated 31/03/2023. Aggrieved by the order of the CGRF, appellant filed the appeal petition to this Authority. On verifying the documents submitted and hearing both the petitioner and respondent and also from the analysis as mentioned above, the following decision are hereby taken. 1. The Licensee has to remove the stay wire from the property of appellant as agreed during the site inspection. 2. The licensee has to bear the cost of this alteration or modification. 3. No order on cost. |

| The appellant Sri. Renjith is a consumer of the licensee under the electrical section, Kambalakkad and power connection was availed on 30/11/1993. The appellant has installed an on-grid solar plant of 3 kwp capacity under MNRE subsidy scheme. The licensee has enlisted few agencies for the supply, installation and commissioning of solar plants under the Soura scheme. The licensee has executed agreement with these agencies with a clause of defect liability period for 5 years and during this period the contractor has to repair/replace solar plant items at their cost. The appellant has selected one of the agency named M/s Kondaas Automation pvt. Ltd. and executed solar plant of capacity 3 kW on 10/05/2022. The solar plant was not giving the required output. As per the advice of the contract agency the appellant requested the licensee to of change the line. On inspection the officials of the licensee noticed very high voltage surge in the line and the frequency of the plant was changed. Then the production from the solar plant was increased and voltage also has increased to 279v and appellant was forced to switch off the plant. The increase in voltage of the solar plant has damaged the stabilizer. The damage would have happened due to wrongly setting the voltage. The main complaint of the appellant to the CGRF was also regarding the voltage problems and no other grievance were raised as per the order of CGRF. In the appeal petition also, no other prayer which was not made with CGRF could be entertained. The respondent has taken initiative and the voltage problem is resolved and the solar plants are working well. |

| അപ്പീൽ പരാതിക്കാരൻ SIEMAT എന്ന സ്ഥാപനത്തിന്റെ Director ആണ്. SI`EMAT(State Institute of Educational Management and Training) പൊതുവിദ്യാഭ്യാസ വകുപ്പിന്റെ ഭാഗമായി പ്രവർത്തിക്കുന്ന ഒരു സർക്കാർ സ്ഥാപനമാണ്. Travancore Cochin Literacy, Scientific & Charitable Societies Act പ്രകാരം രജിസ്റ്റർ ചെയ്തിട്ടുള്ളതും പൊതുവിദ്യാലയ മേധാവികൾക്കും, വിദ്യാഭ്യാസ ഓഫീസർമാർക്കും, വിദ്യാഭ്യാസ സ്ഥാപനമേധാവികൾക്കും, മാനേജ്മെന്റ് ട്രെയിനിങ് നൽകുന്നതുമാണ് ഈ സ്ഥാപനം. SEMAT, ലൈസൻസിയുടെ (KSEBL) തിരുവനന്തപുരം ഡിവിഷന് കീഴിലുള്ള ഫോർട്ട് സെക്ഷനിൽ ഉൾപ്പെട്ട ഉപഭോക്താവാണ്. സർക്കാർ സ്ഥാപനമാണെന്ന് ധരിച്ച് LT VIA താരിഫിൽ ആണ് ഈ സ്ഥാപനത്തിൽ നിന്നും വൈദ്യുത ചാർജ് ഈടാക്കിയിരുന്നത്. എന്നാൽ തിരുവനന്തപുരം RAU നടത്തിയ 2022 നവംബറിലെ പരിശോധനയിൽ LT VIA-ൽ ബില്ല് നൽകിയിരുന്നത് ശരിയല്ല എന്നും LT VIB-ലേക്ക് മാറ്റണമെന്നും റിപ്പോർട്ട് ചെയ്തു. അങ്ങനെ 2016 മുതലുള്ള Short assessment തുക കണക്കാക്കി 2,01,032/-രൂപ SEMAT-ൽ ഈടാക്കാനുള്ള ബിൽ നൽകുകയും ചെയ്തു. 31/10/2023-ൽ KSERC പുറത്തിറക്കിയിട്ടുള്ള താരിഫ് ഉത്തരവ് പ്രകാരം ഇത്തരം സ്ഥാപനങ്ങളെ LT VIA-ൽ ഉൾപ്പെടുത്തിയെങ്കിലും അത് പ്രാബല്യത്തിലായത് 01/11/2023 മുതലാണ്. മുൻകാലങ്ങളിലും ഉള്ള താരിഫ് LT VIA-ആയി നിലനിർത്തി short assessment demand മരവിപ്പിക്കണം എന്ന പരാതി CGRF-ൽ സമർപ്പിക്കുകയും, നടപടി ക്രമങ്ങൾ പൂർത്തിയാക്കി CGRF ഉത്തരവിറക്കുകയും ചെയ്തു. അതിന്റെ അപ്പീൽ പരാതിയായിട്ടാണ് ഈ പരാതി ഓംബുഡ്സ്മാൻ സമക്ഷം സമർപ്പിച്ചിട്ടുള്ളത്. |
