The main dispute relates to the tariff assigned to the consumer’s house, which is used for the stay of his hotel employees. Originally the tariff assigned to the house was under domestic tariff, as it was used for residential purpose. Later, it was discovered, pursuant to an inspection that the house is being used for the stay of the hotel employees and KSEB changed the tariff to commercial. Held that the tariff assigned for such an accommodation or stay is classified as under commercial category.

The KSEB is collecting the MG charge from the consumer in addition to his normal HT bill. The consumer has raised dispute on collecting MG charges for the LT service after its conversion to HT and dismantling of the existing LT connection. It is held that the MG payment has to be continued, whether the said line is dismantled or not, till the consumer completes payments for the guaranteed 7 years. It is decided that, the cost of the taken back materials (less the cost of dismantling work), should be should be given in favour of consumer and if it is more than the MG amount payable by the consumer, the MG liability shall be dispensed with and if there is liability outstanding, even after the adjustment, it shall be payable by the consumer.

The APTS inpection revealed that one of the metering CTs was not working and the other two CTS were also not measuring the consumption correctly. The test conducted with a standard test meter “ACCUCHECK” showed that the error of the meter was 89% of the actual energy consumed. The case settled with the consent of the consumer, by agreeing to assess him for 89% energy loss for the last one year and hence ordered to revise the short assessment bill accordingly.
