അപ്പീൽ പരാതിക്കാരനായ ശ്രീ.ബിജു ടോം, എന്ന വ്യക്തി “Style Pala Metal Products” എന്ന സ്ഥാപനത്തിന്റെ ഉടമസ്ഥനാണ്. പരാതിക്കാരന് 18-06-2003 ന് താരിഫ് LT 4 A പ്രകാരം കൺസ്യൂമർ നമ്പർ. 1156243014607ൽ 129.834 KW connected load ഉളളതും, 03/04/1998 ന് താരിഫ് LT 7 A പ്രകാരം കൺസ്യൂമർ നമ്പർ. 115624012073ൽ 150 W connected load ഉളളതുമായ രണ്ട് സർവീസ് കണക്ഷൻ ലഭിച്ചിരുന്നു. പരാതിക്കാരൻ ലൈസൻസിയെ അറിയിക്കാതെ ക്രഷർ യൂണിറ്റിന്റെ പ്രവർത്തനം നിർത്തിവച്ചു. ലൈസൻസി 01/2020 മുതലുളള fixed charge മാത്രമാണ് പരാതിക്കാരനിൽ നിന്ന് ഈടാക്കിയത്. വൈദ്യുതി വിഛേദിക്കാൻ ഉപഭോക്താവിന്റെ പക്കൽ നിന്നും യാതൊരു അഭ്യർത്ഥനയും ഉണ്ടായിട്ടില്ല. പേയ്മെന്റ് വീഴ്ച വരുത്തിയെങ്കിലും കോവിഡ് 19 കാരണം വൈദ്യുതി വിഛേദിക്കാൻ താമസം നേരിട്ടു. 17/06/2022 ന് കണക്ഷൻ നമ്പർ.14607 ഉം 30/11/2021 ന് കണക്ഷൻ നമ്പർ.12073 ഉം വിഛേദിച്ചു. വൈദ്യുതി ഉപഭോഗം ഇല്ലാതിരുന്ന സമയങ്ങളിൽ fixed charge മാത്രം ലൈസൻസി ആവശ്യപ്പെടുകയുണ്ടായി. പരാതിക്കാരനിൽ നിന്ന് ഉണ്ടായ കുടിശ്ശികയുളള ചാർജ് ഈടാക്കാൻ ലൈസൻസി നടപടി സ്വീകരിച്ചു. ശേഷം പരാതിക്കാരൻ CDRC യെ സമീപിക്കുകയും CDRC പരാതി തളളിക്കളഞ്ഞതിനെത്തുടർന്ന് CGRF നെ സമീപിക്കുകയും 02/12/2024 ൽ CGRF പരാതിക്കാരൻ ബില്ലിന് അനുസൃതമായുളള തുക അടയ്കാൻ ബാധ്യസ്ഥനാണെന്നുളള ഉത്തരവ് പുറപ്പെടുവിക്കുകയും ചെയ്തു. ഈ ഉത്തരവിൽ സംതൃപ്തനല്ലാത്തതിനാലാണ് പരാതിക്കാരൻ ബഹു.ഓംബുഡ്സ്മാൻ സമക്ഷം ഈ പരാതി സമർപ്പിച്ചിട്ടുളളത്.

The appellant Shri. B.R.Ajith is the Chairman of Asian School of Architecture and Design Innovation (ASADI) situated at Silver Sand Island, Vyttila. The said Institute is the Consumer of the Licensee, KSEBL with Consumer No.1155569026814 under the Electrical Section, Vyttila. This three phase LT connection was under LT 6 F tariff and connected load is 53.56 KW. The connection was effected on 12/2014. APTS, Ernakulam has conducted an inspection on 06/2024 and found that pressure coil connection of CT to the meter in R & B phases found to be interchanged which results to wrong phase association. Actual consumption would have been higher than that of the recorded consumption. The short assessment bill was prepared for a period of one year for Rs. 2,51,730/-. Another short assessment bill was prepared for Rs. 6,90,860/- for a period from 05/2020 to 06/2023. The appellant has challenged the short assessment and filed petition to CGRF. CGRF issued order on 10/01/2025 and quashed the second bill and nothing mentioned about the first bill. The appellant was ready to remit the first bill on installment basis and requested for 10 installment. This was not agreed by the Licensee. Then the appeal petition is filed to this Authority.

അപ്പീൽ പരാതിക്കാരനായ ശ്രീ. മുഹമ്മദ് കബീർ ലൈസൻസിയായ KSEBL ന്റെ മണക്കാട്, ഇലക്ട്രിക് സെക്ഷന് കീഴിൽ വരുന്ന ഒരു ഗാർഹിക ഉപഭോക്താവാണ്. 1145016022894 കൺസ്യൂമർ നമ്പരായുള്ള LT 3 phase കണക്ഷന് LT 1 A താരിഫിലാണ് വൈദ്യുത ചാർജ് ഈടാക്കുന്നത്. 08/2022 ൽ റീഡിങ് എടുക്കുമ്പോൾ energy meter തകരാറിലാണെന്ന് കാണുകയാൽ meter status SF (Suspected Faulty ) എന്ന കാറ്റഗറിയിലേയ്ക്ക് മാറ്റുകയും മുൻ മാസങ്ങളിലെ ഉപഭോഗത്തിന്റെ ശരാശരി കണക്കാക്കി ബിൽ നൽകുകയും ചെയ്തു. പരാതിക്കാരൻ ബിൽ തുക കൃത്യമായി അടയ്ക്കുകയും ചെയ്തിരുന്നു. മീറ്റർ മാറ്റി സ്ഥാപിക്കാൻ പലതവണ ലൈസൻസിയുടെ ഉദ്യോഗസ്ഥരോട് ആവശ്യപ്പെട്ടെങ്കിലും മീറ്റർ ലഭ്യമല്ല എന്ന കാരണത്താൽ മാറ്റിയില്ല. ലൈസൻസി കേടായ മീറ്റർ മാറ്റി സ്ഥാപിച്ചത് 12/10/2023 ൽ മാത്രമാണ്. പുതിയ മീറ്റർ സ്ഥാപിച്ച ശേഷം ഉപഭോഗം വളരെ കുറവയാണ് കണ്ടത്. മീറ്റർ മാറ്റി സ്ഥാപിക്കുന്നതുവരെയുള്ള കാലയളവിൽ 02/22,04/22,06/22 എന്നീ ദ്വൈമാസ റീഡിങ്ങിന്റെ ശരാശരി കണക്കാക്കിയത് വളരെ കൂടുതലാണ് എന്ന പരാതിക്കാരന്റെ പരാതിയിൽ ശരിയായ പരിഹാരം കണ്ടില്ല. അതിനാൽ അദ്ദേഹം CGRF ൽ പരാതി നൽകുകയും നടപടികൾ പൂർത്തിയാക്കി CGRF, 27/12/2024 ൽ ഉത്തരവിറക്കുകയും ചെയ്തു. ആ ഉത്തരവ് പ്രകാരം 04/22 ലെ റീഡിങ് വളരെ ഉയർന്നതായതിനാൽ അത് ഒഴിവാക്കിക്കൊണ്ട് ശരാശരി കണക്കാക്കി ബില്ല് നൽകേണ്ടതാണെന്നും അത് പ്രകാരമുള്ള തുക ഉപഭോക്താവ് അടയ്‌ക്കേണ്ടതാണെന്നും പറഞ്ഞിരിക്കുന്നു. ആ ഉത്തരവിന്റെ അപ്പീലായിട്ടാണ് ഇലക്ട്രിസിറ്റി ഓംബുഡ്സ്മാൻ സമക്ഷം ഈ പരാതി സമർപ്പിച്ചിരിക്കുന്നത്.
