The audit party of the Accountant General noticed the anomaly on inspection of records and objected payment of electricity charges under commercial tariff to the building occupied by a govt. institution. On receiving a complaint from the consumer, the KSEB had changed the tariff from LT VIIA (commercial) to LT VIB (non-domestic) w.e.f. 15-11-2010. The request for refund of the excess amount of electricity charges collected under wrong tariff for the last 3 years was not considered by the KSEB. This was the cause for the dispute.

The cause of the dispute is the change of tariff from domestic to commercial category, in the case of the ‘Common Electric service connection’, used for the operation of Lifts, water pumps, Corridor Lighting etc. in the multi storied building, M/s Sheethal Apartments and the issue of subsequent monthly bills accordingly at the higher tariff. The tariff was changed without issuing any notice or hearing their views. The case disposed in favour of the appellant.

The dispute is on the average monthly bills paid by the consumer during meter faulty period as the actual consumption was very low after installing a new meter in the premises. Another demand is to refund the deposited amount in complying with the order of the Hon. High Court. It is decided that the bills of the consumer, for the last two years prior to the meter change, shall be reassessed and the excess amount paid by him with applicable interest shall be adjusted in his future bills and the respondent has been directed to implement the Hon. Court order by revising the penal bills.
