The review appellant herein in Appeal No P-337/2013, is Sri James Jose, Managing Director, Cochin Assay [P] Ltd., Ravipuram, Ernakulam with consumer No. 9277 under Electrical Section, College, Ernakulam. The service connection was registered with effect from 28-06-2002 under LT VII A tariff. Pursuant to an application submitted by the appellant by the tariff of the said premises was changed from LT VII A to LT IV with effect from 15-04-2005. On 18-09-2012, the APTS team conducted an inspection in the premises and detected that only quality testing and certification (hallmarking) process was carried out in the units and there was no production of bullion products carried out in the premises. Hence a short assessment bill was issued to him for Rs. 18,99,602/- with effect from 15-04-2005 the date of change of tariff from commercial to industrial. Being aggrieved by the impugned short assessment bill and change of tariff, the review appellant has filed a complaint before the CGRF which held that assessment to be revised under LT VII A tariff within 2 weeks and the amount shall be permitted to be remitted in 15 equal instalments with applicable interest. Aggrieved against the orders, the review appellant filed appeal petition before this Authority which was disposed upholding the decision of CGRF, vide order dated 30-10-2013. Now the review appellant has submitted this review petition with a plea to review based on the direction issued by Hon’ble KSERC in OP No. 13/2012. It is decided to limit the recovery of short assessment under LT VII A tariff from the date of detection of irregularities. The review petition is admitted.

The review appellant herein in Appeal No P-336/2013, is Sri James Jose, Managing Director, Chemmannur Gold Refinery [P] Ltd. M.G. Road, Ernakulam with consumer No. 12482 under Electrical Section, College, Ernakulam. The review appellant was issued a short assessment bill for an amount of Rs. 12,22,884.00 on the basis of APTS inspection on 18-09-2012. During the inspection it was found that only quality testing and certification (hallmarking) process was carried out in the appellant’s premises and there was no production of bullion products. The review appellant approached CGRF against the said bill and later approached this Authority with an appeal petition No. P-336/2013. While disposing the appeal petition it was directed the respondent to reassess the appellant for differential tariff rates due to wrong tariff fixation, limiting for a period of two years from 10/2010 to 09/2012. Aggrieved against the above order, the review appellant has submitted this review petition with a plea to review based on the direction issued by Hon’ble KSERC in OP No. 13/2012. It is decided to limit the recovery of short assessment under LT VII A tariff from the date of detection of irregularities. Review petition is admitted.

The appellant, M/s Mathewsons Food Specialties (P) Ltd, Kaloor, Ernakulam is an HT IV consumer with consumer code 13559600010401 and having Contract Demand of 125 KVA under Electrical Section, Valayanchirangara. The appellant is a Private Limited Company engaged in the manufacture of SARO brand/ private labelling of frozen range of heat and eat/ ready to cook vegetarian food products. The factory of the appellant is situated at B-32, Kinfra Industries Park, Nellad P.O., Ernakulam district. The grievance of the appellant is against the wrong and incorrect fixation of tariff by the KSEBL under HT lV Commercial whereas the appellant is eligible to get a classification under HT-1 Industrial tariff from the date of connection namely 26-06-2011. Aggrieved by this, the appellant filed a petition before the CGRF, Ernakulam which was dismissed vide order no. CGRF-CR/Comp.122/2014-15 dated 19-02-2015. Challenging the decision of the CGRF, the appellant approached this Authority by filing an appeal petition on 18-03-2015. It is decided to reclassify the tariff of the appellant as HT-I(Industrial) from the date of connection. Excess amount remitted by the appellant shall be adjusted or refunded against the future bills. Appeal is admitted. CGRF order set aside.
