The Deputy Chief Engineer, Electrical Circle, KSEB Ltd., Ernakulam, the respondent in appeal petition No. P/351/2013 is the review petitioner herein this petition. The review respondent is a HT industrial consumer with consumer no. HTB-12/4472 under Electrical section Puthencruz and he was issued with a short assessment bill amounting to Rs. 8,02,085/- by Special Officer (Revenue), KSEB, Thiruvananthapuram, the penal charges for non segregation of power and light loads of his industry pertaining to the period of 9/2010 to 10/2012. Aggrieved by the above, the review respondent filed a complaint before the CGRF, Ernakulam against the short assessment bill issued and the Forum dismissed the same vide Order OP No. CGRF-CR/Comp.110/12-13 dated 25-01-2013. Not satisfied by the above decision of CGRF, the review respondent has submitted an Appeal Petition before this Authority in Appeal No.P/351/2013. The appeal petition filed by the review respondent was found having merits and was allowed to the extent it was ordered. Now the Review petitioner has submitted that a factual error occurred in the order issued by this Authority and therefore requested to review the order dated 31/1/2014 and to dismiss the said appeal petition. In the review petition nothing is pointed out which escaped the notice of this Authority while disposing the matter. Review petition is not maintainable and hence rejected. |

The appellant, Smt. Sonia Rajeev, Proprietrix of M/s Caravan Softies is a registered consumer with consumer No. 788 under Electrical Section, College, Ernakulam. On 24-04-2013, the Audit Wing of KSEB Limited verified the records and monthly Meter Reading Register of the appellant and detected that adequate capacitors are not installed in the appellant’s premises and directed to charge the appellant 20% extra on Fixed charges and Energy charges for the period from 12/2009 to 06/2012. Accordingly a short assessment bill for Rs. 61,324/- under Regulation 24 (5) was issued to the appellant on 15-05-2013. Aggrieved by this, the appellant approached CGRF by filing complaint No. 94/2014. The Forum in its order dated: 08-01-2015 disposed the case by limiting the period of assessment for 2 years preceding the date of issuance of bill. Not satisfied with the above order, the appellant filed an appeal before this Authority 24-02-2015. 20% extra charges demanded by the respondent for the period from 12/2009 to 06/2012 is arbitrary and hence unsustainable. It is directed to refund the amount already remitted by the appellant along with interest within 30 days from the date of receipt of this order. Appeal is admitted. CGRF order set aside. |

The appellant is a commercial consumer with consumer No. 12469 under LT-VII (B) tariff having a connected load of 360 watts. A surprise inspection was conducted by the Electrical Sub Division Squad, Vypin on 30-04-2014 in the above premises. During the inspection it was detected that the premises was being used as a rest room for the staff of an HT consumer, M/s Cochin Sea Port Hotel. A mahazar was prepared based on the findings of the inspection conducted and the respondent changed the tariff from LT VII B to LT VII A and also issued a short assessment bill amounting to Rs. 17,191/-. The appellant filed a complaint before the CGRF, Ernakulam which was disposed with a finding that “the respondent’s decision to allot LT VII A tariff to the above consumer is in order”. Aggrieved against the above order, the appellant has submitted this appeal petition before this Authority. The respondent is directed to reclassify the appellant's category to LT VII B within a period of 30 days and disposed accordingly. |
