Unauthorized use of electricity by extending supply from one building to another building in the premise of the appellant was detected by the APTS team in a surprise inspection. It is confirmed that unauthorized extension of electric supply has occurred in the premises of the appellant. As it is a case of unauthorized use of electricity under Section 126, the appeal petition is not maintainable before this Forum and disposed of accordingly.

Appellant’s brother has obtained an electric connection in his name, to a building constructed in the land actually owned by the appellant. The appellant has requested for change of ownership of the existing connection of the said building from his brother’s name to his name which was rejected by KSEB. Since the Panchayath has issued order changing the ownership of the building in appellant’s name and his brother has not disputed, it was ordered to change the name of electric connection. But the service should not be disconnected till the dispute going on in the Civil Court decides on the matter of occupancy/ownership of the said building.

The Electric connection is seen located in an unnumbered building which is functioning as a textile shop for the last few years. The occupier of the textile shop and user of the electric connection is the one who presently runs the shop and not the registered owner. It is alleged that the meter was shifted unauthorisely from a nearby building.The registered owner has submitted application for dismantling the connection and remitted required fees. The request for dismantling could not be implemented without the concurrence of the occupier of the premises who is also the present user of electricity. It is ordered to retain the service till the Case going on in the Civil Court decides on the matter of occupancy/ownership of the said building.
