Following the inspection of APTS of KSEB Ltd. in the premises of the appellant, the electric supply was disconnected after preparing a site mahazar by the respondent. The respondent issued a penal bill for Rs. 136,047/- stating the reason of “meter tampering” in accordance with Section 126 of the Electricity Act 2003. The appellant approached CDRF, Thiruvanthapuram for compensation and cost, which were allowed by the Forum. The electric supply was reconnected as ordered by the Hon’ble High Court of Kerala. Against the order of CDRF, Thiruvananthapuram the respondent filed appeal petition before Hon’ble SCDC, Thiruvananthapuram, which is under the consideration of Hon’ble Commission. The appeal petition filed by the appellant stands dismissed as it is found not maintainable before this Authority. The order dated 02-02-2021 in OP No. 82/2020 of CGRF, Southern Region is upheld.

The institution Daya Rehabilitation is intended to run as a Dialysis Centre for the poor patients of the district. The appellant had requested for 40 kW power for the Dialysis Centre for which KSEB Ltd. issued a demand note for Rs.15,61,231/- towards the network strengthening expense. The appellant filed a petition before CGRF and the Forum in its order directed the Licensee to strengthen the existing network and check the feasibility to provide the power requirement of the “Trust” giving due consideration to the intention behind the need for power. Accordingly, KSEB Ltd. prepared a revised estimate for Rs.62,832/- and the appellant remitted the amount. The appellant again approached CGRF with a request to direct KSEB Ltd. to refund the estimate amount realized by the respondent for the construction of electric line along the public road. But the Forum rejected the request of the appellant and hence, the appellant filed this appeal petition. The appellant is liable to bear the expenditure for the conversion of his single-phase low tension electric line to three phase low tension electric line along the public road and the premises. The order of CGRF, Northern Region in OP No.94/2020-21 dated 27-01-2021 is upheld. The respondent shall prepare an evaluation statement of the work based on actual quantities and excess remittance shall be refunded by adjustment in the monthly energy charge/direct refund within a period of 30 days from the date of order.

The appeal petition subject pertains to the shifting of a 100 kVA distribution transformer erected by KSEB Ltd. in 2017 under Electrical Section, Pampady under Electrical Circle, Palai. The appellant is not a consumer of Electrical Section, Pampady, but having some landed property in the Section office area. The respondent erected the transformer in the road side and near to the boundary of the property. As per respondent, if the shifting is to be done, the shifting charge required shall be met by the appellant and there will not be any objections from any part around the newly proposed location. The respondent had taken up the subject before the District Magistrate, Kottayam. Since the respondent did not take action to shift the transformer, the appellant filed a petition in CGRF, Southern Region and the Forum in its order issued the following : (1) “The respondent is directed to ascertain and confirm whether the transformer fencing or any other portion of transformer installation have situated, the licensee shall shift that portion of the installation at their own cost within two months.” (2) “The respondent is also directed to prepare a detailed estimate for shifting the entire transformer installation to a convenient place as requested and intimate the same to the petitioner.” From the analysis done and the conclusions arrived at, it is decided to reject the appeal petition filed by the appellant since the same subject is before the District Magistrate for a decision. The order of CGRF, Southern Region in OP No. OP No. 62/2020 dated 01-01-2021 is set aside.
