The appellant is a domestic consumer having single phase service connection bearing consumer no: 1145235021437 with a registered connected load of 2020 watts under Electrical Section, Mangalapuram. The appellant was aggrieved by the bill issued on 01/11/2019 amounting Rs. 2795/- for the consumption recorded as 163 units. Aggrieved by this, the appellant had approached the CGRF, Kottarakkara by filing a petition in OP No. 123/2019. The Forum disposed of the case in favour of KSEBL as the bill issued was for the actual consumption and that the appellant is liable to pay the bill, vide order dated 16-01-2020. Against the decision, the appellant has submitted this appeal petition before this Authority on 11-02-2020. For the reasons detailed above, the appeal petition No. P/012/2020, filed by the appellant stands dismissed as it is found having no merits. The order dated 16-01-2020 in OP No. 123/2019 of CGRF, Kottarakkara is upheld. Having concluded and decided as above, it is ordered accordingly. No order on costs.

The appellant is a domestic consumer having consumer number 33500 under Electrical Section, Adoor. The connection was effected on 13-06-2018 under LT VIF tariff for the purpose of construction of a residential building. Consequent on completion of construction the tariff of the respective service connection was changed to LT I(a) w.e.f. 16-O8-2019. The appellant was served with a bill dated 20-11-2019 amounting to Rs. 13,619/- for the bimonthly consumption of 1531 units. The appellant approached the CGRF, Kottarakkara requesting to cancel the bill. The CGRF has dismissed the Petition on finding that the bill issued by the respondent was in order and the petition was found as devoid of any merits, vide its order No. OP 122/2019 dated 13-01-2020. Aggrieved by the decision of CGRF, the appellant has submitted the Appeal petition before this Authority on 28-01-2020. From the findings and conclusions arrived at as detailed above, I decide to set aside the electricity bill amounting to Rs. 13619/- issued to the appellant. The respondent is directed to revise the bill for the consumption period from 20-09-2019 to 20-11-2019 by taking the average of three bi-month’s consumption in the meter after the defect of the main switch is rectified. Having concluded and decided as above, it is ordered accordingly. The Appeal Petition filed by the appellant is found having some merits and is allowed. The order of CGRF, Kottarakkara in Petition No. OP122/2019 dated 13-01-2020 is set aside. No order on costs.

Service connection bearing Consumer No. 1156008021977 was given in respect of Sri Arun David, Managing Partner, M/s Kothamangalam Aggregates Prestressed Concrete Industries, Ayroorpadam P.O, Kothamangalam under Electrical Section, Kothamangalam No. l. The sanctioned load of the premises was 45KW whereas the consumer was based on demand-based tariff with Contract demand of 30 kVA. The appellant remitted under protest Rs.5,82,411/- towards the cost of installation of 100 kVA transformer for 105 kW additional power as part of expansion of his industry with Contract demand of 100 kVA. Against the demand, the appellant had approached the CGRF, Ernakulam by filing a petition No. OP No. 39/2019-20. The Forum dismissed the petition vide order dated 29-11-2019. Aggrieved against this, the appellant has submitted this appeal petition before this Authority on 31-12-2019. In view of the above discussions, it is directed the respondent to dispose the subject on the basis of the final decision of the Hon’ble High Court of Kerala in the Writ Petition No. 25347/2016 (P). The respondent will consider the request for refund on the basis of the disposal of the writ petition filed by them. The appeal filed by the appellant is disposed of accordingly. Having concluded and decided as above it is ordered accordingly. No order as to costs.
