The cause of the dispute is the change of tariff from HT-II- non industrial/ non commercial rate to HT-IV- commercial rate in the case of HT service connection provided to M/s Cochin Port Trust and issue of subsequent short assessment bill retrospectively accordingly. This tariff reclassification and issue of arrear bill has been done based on an audit observation of Accountant General. Dispute.

The KSEB has demanded unconnected minimum charges from the consumer for the sanctioned contract demand inspite of the availed contract demand. The appellant remitted the UCM charge as demanded by the KSEB. The consumer requested to consider the date of completion of work as the date of energisation approval from the Electrical Inspector and to refund the UCM amount collected with interest.

The complete Electrical works of 11 KV cable laying up to consumer premises from the nearby existing distribution system, erection of indoor Transformer and all the allied HT and LT side works and terminal arrangements including LT metering panel in the High rise building were all done by the appellant themselves, after incurring its material and labour costs and paying the Supervision charges to KSEB. The appellants insists that the material cost and some extraneous costs need not be taken for calculating the 10% Supervision charge by KSEB. The appellants also opposes the collection of cost of RMU as it is a part of the Licensee’s distribution system and other sums such as road cutting charges, PTCC approval amount and miscellaneous costs included in the estimate prepared by KSEB.
