The appellant’s electric OH line shifted along the route suggested by him on work deposit basis. The neighbours complained that the newly shifted line crosses into their property slightly and the same line was shifted along their passageway without obtaining their consent and requested to remove the crossing. The KSEB officials have issued a demand notice as shifting charges of the work of the electric lines. This is the cause for the appeal.

The Distribution Licensee of electricity in the Munnar area was the employer of the appellant. Due to a labour dispute, the licensee tried to evict the appellant from the quarters of the employer and he disconnected electric connection without a notice. An industrial dispute raised by the appellant is still pending in the court and the appellant has obtained an injection order against forceful eviction from the company quarters. It is ordered to give reconnection of the electric supply to the appellant’s quarters within 24 hours.

The appellants are the employees of KSEB and the consumer has raised some allegations against them among other things in a petition filed before CGRF. The CGRF has ordered to refund the excess amount collected from the petitioner from the pockets of the appellants. A review petition filed by the employees before the CGRF was disposed of without hearing them. The appellants approached Hon High Court and it was directed to hear the case by this Authority. It is held that the Board may refund the excess amount collected, since the same lie with KSEB A/C and also directed to pay litigation cost by the appellants.
