| The appellant, the Managing Director of M/s POABS Enterprises (P) Ltd is a commercial consumer with consumer No.19693 under Electrical Section, Peerumadu. It is alleged that the appellant had submitted vide letter dated 4/3/2014 before the Assistant Engineer requesting to change the tariff wrongly assigned to him. But the officers of the respondent have not taken any action on this request and hence the appellant filed a petition before the CGRF, (Central Region), Ernakulam on 12/08/2014, which was disposed directing the respondent to process the appellant’s application for change of tariff as per rules. Aggrieved by the Order No. 79/2014-15 dated 27/11/2014 of CGRF, the appellant has submitted this appeal before this Authority. Order of CGRF is modified and appeal is allowed to the extent as ordered. |

| The appellant is the Director of Mar Augustine Golden Jubilee Hospital (MAGJ Hospital) having an electric connection with consumer no. 286 of the Electrical Section, Mookkannoor under VI A tariff. On 23/05/2014, the appellant was issued with a short assessment bill amounting to Rs. 14,11,259/- for wrong classification of tariff for the period from 12/2007 to 04/2014. Aggrieved by this, the appellant approached the CGRF, Ernakulam by filing a Complaint No. 48/2014-15. The CGRF disposed the complaint directing the respondent to revise the short assessment (bill dated 2305/14 amounting to Rs. 14,11,259/-) by limiting the period of assessment for 2 years preceding 23/05/2014 i.e. the date of issuance of the bill and the reclassification of tariff as LT VIII with effect from 05/2013 is in order. Aggrieved by the above decisions of CGRF the appellant has submitted this appeal petition before this Authority. CGRF order is modified and appeal is allowed to the above extent as ordered. |

| The appellant is the Managing Director of M/s POABS Enterprises (P) Ltd having service connections with consumer Nos. 14415, 14526, 14949 and 15574 under Electrical Section, Vandiperiyar. The appellant made a request vide letter dated 4/3/2014 before the Assistant Engineer to change the tariff wrongly assigned by the respondent i.e. from LT VII A ‐ commercial to LT IV A industrial. According to the appellant, as the service connections are being used for various industrial purposes like cardamom drying unit, tea packing unit, workshop and water pumping station, the tariff applicable is LT IV A. But the respondent has not taken any action on this regard, hence the appellant filed a complaint before the CGRF (Central Region), Ernakulam on 12/08/2014, which was disposed as follows: “Forum finds that the Petitioner is unable to substantiate his claim that formal application was submitted 04/03/2014 and the respondent was reluctant to accept the same. As such, there is nothing to prove deficiency of service on the part of the respondent. In the above circumstances, respondents are directed to process petitioner’s application for change of tariff as per rules, once petitioner submits the formal applications with necessary documents and remits the application fees.” Aggrieved by the Order No. 80/2014-15 dated 27/11/2014 of CGRF, the appellant has submitted the appeal dated 17/12/14 before this Authority. It is decided to reclassify the tariff of the appellant with retrospective effect subject to the request is found genuine. Excess amount if any remitted shall be refunded or adjusted against the future bills. Appeal is disposed of as above. |
