The appellant is the Principal, College of Engineering, Karunagappally. The service connection with consumer No. 21180 having a connected load of 23 kW was effected on 07-10-2003 to the appellant under of Electrical Section, Karunagappally South. On the basis of audit report of the Accountant General, Kerala, a short assessment bill dated 18-12-2012 amounting to Rs. 58,936/- was issued to the appellant for the misclassification of tariff, being the loss sustained by KSEB during the period from 02/2008 to 04/2012. Due to non remittance of the short assessed amount, Revenue Recovery Notice for an amount of Rs. 70,960/- was issued to the appellant by the Tahasildar, Karunagappally. Aggrieved by the aforesaid order, the appellant filed a complaint before the CGRF (South), Kottarakkara in OP No. 1259/2014 which was not allowed. Hence the appellant filed this appeal petition before this Authority. CGRF order is set aside and appeal is allowed.

The Review Appellant, the Assistant Engineer, KSE Board, Electrical Sub Division, Kundara has issued a provisional bill for Rs. 69,632/- and a calculation statement including compounding fee for Rs. 20,000/-, under Section 135 & 138 of Electricity Act, 2003 to the review appellant. Aggrieved by the above, the review respondent filed a complaint before the CGRF, Kottarakkara and the Forum disposed the same vide Order OP No. 916/2013 dated 16.4.2013. Not satisfied by the above decision of CGRF, the review respondent has submitted an Appeal Petition before this Authority in Appeal No.P/371/2013. The appeal petition was disposed of having allowed the plea to the extent it was ordered. Now the Review Appellant has submitted that a factual error occurred in the order issued by this Authority and therefore requested to review the order dated 31/3/2014 and to dismiss the said appeal petition. Review Petition is not maintainable and hence rejected.

The Deputy Chief Engineer, Electrical Circle, KSEB Ltd., Thodupuzha, the respondent in appeal petition No. P/372/2013 is the review petitioner herein this petition. The review petitioner has issued a short assessment bill for Rs. 6,19,496/- as the extra charges, worked out at 20% of the regular monthly bill, for the period from 10/2010 to 11/2012, to the review respondent. Aggrieved by the above, the review respondent filed a complaint before the CGRF, Ernakulam and the Forum has reduced the arrear bill to 12 months vide its order No. CGRF-CR/Comp.170/12-13 dated 26-04-2013. Not satisfied by the decision of CGRF, the review respondent has submitted an Appeal Petition before this Authority in Appeal No. P/372/2013 which was disposed that the disputed bill shall be revised to one month i.e. 11/2012 only. Now the review petitioner has submitted that a factual error apparent on the face of the records crept into the order dated 31-01-2014 issued by this Authority. The review petitioner has therefore submitted that the order sought to be reviewed causes serious prejudice and hardship to the review petitioner and requested to review the order dated 31-01-2014 and to dismiss the said review petition. Review petition is not maintainable and hence rejected.
