| The appellants Sri K. Surendran & Smt. S. Ushakumari are the owners of 10 cents of land comprised in Resurvey No. 131/14 of Parassala Village. On 25-02-2012, the appellants gave a licence to one Sri Vandrose for running a driving school in a semi permanent shed bearing Door No VIII/VI A in the above said property for a period of 3 years. Sri Vandrose obtained an electricity connection with consumer No. 23631 under the jurisdiction of Electrical Section, Parassala, with the consent of the appellants. After completing the license period of 3 years the appellant has not renewed the agreement further. The appellants wanted to change the name of the registered service connection with consumer No. 23631 to the appellant’s name and hence approached with an application to the Assistant Engineer, Electrical Section, Parassala and Assistant Executive Engineer, Electrical Sub Division, Parassala which was not allowed by them. Aggrieved by this, the appellants filed a petition before the CGRF, Kottarakkara vide OP No.1658/2015. The CGRF disposed of the petition with a direction to the respondent to change the name of the registered consumer on production of the documents by the appellants as per the model application form for change in name of registered consumer Annexed to the Regulation 90(1) of Kerala Electricity Supply Code, 2014. Not satisfied with the above decision of the CGRF, the appellant submitted this appeal petition before this Authority. In view of the discussions, it is concluded that the respondent is directed to change the name of the appellants on deposit of security amount afresh by the appellants as per Regulation 91(4) (f) and observing all other formalities. This shall be done at any rate within 30 days from the date of receipt of this order. It is also made clear that the security deposit remitted by Sri Vandrose can be refunded to him on his application if any as per the prevailing rules. The order of CGRF in OP No. 1658/2015 & 3/2016 dated 14-03-2016 is set aside. No order as to costs. |

| അപ്പീല്‍ പരാതിക്കാരനായ ശ്രീ ജോണ്‍സണ്‍ ജോര്‍ജ് കരുവാളൂര്‍ ഇലക്ട്രിക്കല്‍ സെക്ഷനിലെ 6992 നമ്പരായി രജിസ്റ്റർ ചെയ്തിട്ടുള്ള വൈദ്യുതി ഉപഭോക്താവാണ്. അപ്പീല്‍ പരാതിക്കാരന്റെ വീടിന്റെ മുറ്റത്ത് അനധികൃതമായും നിയമവിരുദ്ധമായും സ്ഥാപിച്ചിട്ടുള്ള TVMK-133 നമ്പര്‍ ഇലക്ട്രിക് പോസ്റ്റ് തൽസ്ഥാനത്തു നിന്ന് മാറ്റി റോഡരികില്‍ സ്ഥാപിക്കുവാന്‍ വേണ്ടിയാണ് പരാതി നല്‍കിയത്. ഇതേ ആവശ്യത്തിലേക്കായി പരാതിക്കാരന് കണ്‍സ്യൂമര്‍ ഗ്രീവന്‍സ് റിഡ്രസ്സല്‍ ഫോറം, കൊട്ടാരക്കര മുമ്പാകെ അപ്പീല്‍ നല്‍കുകയും ടി അപ്പീലില്‍ OP-1657/2015 ആയി നല്‍കിയ ഉത്തരവില്‍ സാങ്കേതിക വശങ്ങള്‍ പരിശോധിച്ച് പോസ്റ്റും ലൈനും മാറ്റി സ്ഥാപിക്കുന്നതിന് ആവശ്യമായ പ്രവര്‍ത്തിചെലവ് പരാതിക്കാരനില്‍ നിന്ന് ഈടാക്കിയതിനു ശേഷം പ്രസ്തുത ജോലികള്‍ ചെയ്തു തീര്‍ക്കുന്നതിന് തീര്‍പ്പ് കല്‍പ്പിട്ടുള്ളതാണ്. എന്നാല്‍ അപ്പീല്‍ പരാതിക്കാരന്റെ ചെലവില്‍ പോസ്റ്റ് മാറ്റിസ്ഥാപിക്കണം എന്നുള്ള CGRFന്റെ ഉത്തരവിനു എതിരായിട്ടാണ് ഇപ്പോള്‍ അപ്പീല്‍ പരാതി നല്‍കിയിട്ടുള്ളത്. സ്ഥലം ഉടമസ്ഥന്റെ അനുമതി ഇല്ലാതെ സ്ഥാപിച്ച പോസ്റ്റും ഇപ്പോള്‍ പരാതിക്കാരന്റെ വീടിനോട്‌ ചേര്‍ന്ന്‍ അപകടകരമായി വലിച്ച ലൈനും ഈ ഉത്തരവ് ലഭിച്ച് ഏഴു ദിവസത്തിനുള്ളില്‍ എതിര്‍കക്ഷിയുടെ ഉത്തരവാദിത്വത്തില്‍ മാറ്റി സ്ഥാപിക്കേണ്ടതാണ്. അപ്പീല്‍ പരാതിക്കാരന് ഈ വിഷയത്തില്‍ യാതൊരു ബാദ്ധ്യതയും ഉണ്ടായിരിക്കുന്നതല്ല. ഇതിന് വരുന്ന ചെലവ് ഏതു വിധേന ഈടാക്കണം എന്ന തീരുമാനം എതിര്‍കക്ഷിക്ക് എടുക്കാവുന്നതാണ്. അപ്പീല്‍ പരാതിക്കാരന്റെ ചെലവില്‍ പോസ്റ്റ് മാറ്റിസ്ഥാപിക്കണം എന്നുള്ള CGRFന്റെ വിധിഭാഗം റദ്ദ് ചെയ്ത് മേല്‍ ഉത്തരവ് പുറപ്പെടുവിക്കുന്നു. മറ്റു ചെലവുകള്‍ അനുവദനീയമല്ല. |

| Sri Prabhakaran, Kurumbi Veedu, Attapuram, Kulathoor, Uchakada and five other consumers with consumer Nos. 10407, 10651, 10655, 10581, 10686 and 10748 under Electrical Section, Parassala had approached CGRF (South), Kottarakkara with a petition stands numbered as 1622/2015 requesting not to disconnect their service connections until the disposal of OS 456/2010 by the Munsiff Court, Neyyattinkara. The service connections were given to the above consumers on the basis of ownership certificate issued by the Secretary, Kulathoor Grama Panchayath. Meanwhile, Sri Sunil Kumar, Padmanabha Soudam, Kulathoor, appellant in this petition, raised a complaint on 26-09-2014 before the Deputy Chief Engineer, Electrical Circle, Kattakkada stating that the service connections in question were obtained illegally on production of fake ownership certificate. Hence he requested to dismantle the service connections mentioned above. Regulation 22 (d) states that “Maintainability of the Complaint‐ (1) no representation to the Ombudsman shall lie in case where a representation for the same grievance by the complainant is pending in any proceedings before any Court, tribunal or arbitrator or any other authority or a decree or award or a final order has already been passed by any such Court, tribunal, arbitrator or authority”. So in view of the above discussions, I hold that the appeal is not maintainable. In the above circumstances it is concluded that the appeal is not maintainable and hence dismissed. No order as to costs. |
