The Believers Church Hospital, Thiruvalla is an EHT consumer of the Licensee (KSEBL). The EHT agreement was executed by the appellant with the licensee on 27/11/2014 and the tariff applicable was EHT General which was the prevailing tariff as per the tariff order dated 14/08/2014 of KSERC. The KSERC by tariff order dated 17/04/2017, the EHT tariff has been categorized into EHT General A & B. The tariff applicable for the Self Financing Institution was EHT General B. The licensee billed the appellant wrongly on EHT General A and the anomaly was detected only on 06/22. In the latest tariff order dated 25/06/2022, the self financing institution were categorized into EHT General C. The licensee had raised bill for the undercharged period for an amount of Rs.9,90,74,445/-. The appellant filed the case to Hon’ble High Court of Kerala challenging the demand raised by the licensee. Hon’ble High Court of Kerala issued order permitting the appellant to remit 2 Crores in two equal or six weekly instalments and the balance amount in 36 equal monthly instalments. The licensee has charged interest for the payment which was not paid within the due date. The appellant has filed a case to the Hon’ble High Court of Kerala and Hon’ble High Court Of Kerala directed the appellant to approach CGRF. Accordingly, the petition has been filed to the CGRF and CGRF issued order stating that the appellant is liable to pay the interest. Aggrieved by the order of CGRF, the appeal petition is filed to this authority.

The appellant Sri. Jayakumar K is the Asst. General Manager of Global Education Trust which owns a school named Global Public School. This trust is a high Tension Consumer of the licensee (KSEBL) under the Electrical Section, Mulanthuruthy. This connection was availed on 14/07/2010 under HT II B General Tarif, and the connected load is 178.02 kw with contract demnd of 100kVA. The CT unit of the meter became faulty during 11/2017 and faulty meter was replaced with a new meter on 12/01/2018. The multiplication factor of the new CT meter is 2 against that of 1 of the old CT meter. This mistake was noticed during the time of installation of solar meter and accordingly short assessment bill for the period from 01/2018 to 01/2021 was prepared with the correct multiplication factor 2 for Rs. 22,30,444/-. The consumer initially made the part payment and then the balance payment was also made on 30/02/2023. The appellant has requested the licensee to limit the short assessment for a period of two tears and also to sanction 12 monthly instalments to remit without interest and surcharge. No positive response for their request and then the appellant approached CGRF and CGRF issued order dated 11/09/2023 stating that the petitioner is liable to pay the short assessment bill. Aggrieved by the decision of CGRF, the appellant approached the authority by filing the appeal petition.

പരാതിക്കാരൻ കേരള സംസ്ഥാനത്തിന് കീഴിലുള്ള നിയമ പ്രകാരം രൂപീകൃതമായ സ്റ്റേറ്റ് യൂണിവേഴ്സിറ്റിയായ കണ്ണൂർ യൂണിവേഴ്സിറ്റിയുടെ രജിസ്ട്രാർ ആണ്. കണ്ണൂർ സർവകലാശാലയാണ് B. Ed. പരിശീലന കേന്ദ്രം കാസർഗോഡ് സ്ഥാപിച്ചത്. കണ്ണൂർ സർവകലാശാലയുടെ കാസർഗോഡ് ക്യാമ്പസ്‌ (Consumer No. 1166886020570) KSEBL ലൈസൻസിയുടെ ഒരു ഉപഭോക്താവാണ്. Govt./Aided സ്ഥാപനങ്ങൾക്കു ബാധകമായ താരിഫ് പ്രകാരം KSEB കാസർഗോഡ് ക്യാമ്പസ്സിൽ നിന്ന് വൈദ്യുത ചാർജ് ഈടാക്കി വന്നിരുന്നു. സ്വാശ്രയ വിദ്യാഭ്യാസ സ്ഥാപനങ്ങൾക്കായി കേരള സ്റ്റേറ്റ് ഇലക്ട്രിസിറ്റി റെഗുലേറ്ററി കമ്മീഷൻ തീരുമാനിച്ച താരിഫ് അംഗീകരിച്ചുകൊണ്ട് ബഹുമാനപ്പെട്ട സുപ്രീം കോടതിയുടെ ഉത്തരവ് പ്രകാരം, ലൈസൻസി ഈ centre-ന്റെ താരിഫ് 6F ആക്കി മാറ്റുകയും ഒരു കാലയളവിലേക്ക് ഒരു ഹ്രസ്വ മൂല്യനിർണ്ണയ ബിൽ നൽകുകയും ചെയ്തു. 7/2009 മുതൽ 7/2015 വരെ രൂപ. 5,87,486/-. സർവകലാശാലയുടെ അപേക്ഷയൊന്നും അംഗീകരിക്കപ്പെട്ടില്ല, തുടർന്ന് അപ്പീൽക്കാരൻ CGRF-നെ സമീപിച്ചു. CGRF 10/03/2022 തീയതിയിൽ ഒരു ഉത്തരവ് പുറപ്പെടുവിച്ചു, ലൈസൻസിയുടെ ഡിമാൻഡ് നോട്ടീസ് അനുസരിച്ചുള്ള ചാർജുകൾ അടയ്‌ക്കാൻ അപ്പീൽ പരാതിക്കാരൻ ബാധ്യസ്ഥനാണെന്ന് പ്രസ്താവിച്ചു. തർക്കം അവിടെയും പരിഹരിക്കപ്പെടാത്തതിനാലാണ് Ombudsman-ന് പരാതി സമർപ്പിച്ചത്. സമർപ്പിച്ച രേഖകൾ പരിശോധിച്ച്, പരാതിക്കാരന്റെയും എതിർകക്ഷിയുടെയും വാദം കേൾക്കുകയും, മുകളിൽ സൂചിപ്പിച്ച വിശകലനത്തിൽ നിന്ന് ഇനിപ്പറയുന്ന തീരുമാനം എടുക്കുകയും ചെയ്യുന്നു. 1. എതിർകക്ഷി പരാതിക്കാരന് നൽകിയിട്ടുള്ള ഷോർട്ട് അസ്സെസ്മെന്റ് ബില്ല് റദ്ദാക്കിയിരിക്കുന്നു. 2. കണ്ണൂർ സർവ്വകലാശാലയുടെ കീഴിലുള്ള കാസർഗോഡ് കേന്ദ്രം എയ്ഡഡ് സ്ഥാപനങ്ങളുടെ ഗണത്തിൽ പെടുത്താവുന്നതിനാൽ 6A താരിഫാണ് ബാധകം. 3. മറ്റു ചിലവുകൾ ഒന്നും അനുവദിക്കുന്നില്ല
