An inspection done by the APTS detected unauthorized additional load at the premises of the appellant, an HT consumer. The dispute is regarding the quantum with respect to the sanctioned connected load and the irregularity falls squarely within the ambit of Section 126 of Electricity Act 2003 and was not maintainable before the CGRF and EO. The Hon High Court directed EO to hear and dispose as per Law.

The consumer who was running an industrial unit defaulted electricity charges due to loss and therefore the service was disconnected. Later the consumer’s power supply was restored based on Hon: High Court order. The consumer informed the Board that she is not in a position to run the industry due to mounting loss and requested to dismantle the supply. Even though supply was disconnected, it was not dismantled, due to filing of a case at Munsiff court. Thereafter the dismantling of connection was done and RR action initiated. What is the arrears of electricity charges actually payable. This was the cause for the petition.

The KSEB had detected unauthorised additional load being used in the premises of the consumer and charged 1.5 times for the period in question under Section 126 of IE Act, 2003. While so, the RAO, KSEB inspected the office billing records and found that the consumer was not billed for proportionate energy charges of UAL, as per rules, during the said period. The consumer was issued short assessment bill for recovering the loss. Dispute.
