The consumer has defaulted in paying electricity charges for a long period and the KSEB had disconnected the service connection due to non-payment of arrears.The consumer has not availed the benefit of one time settlement granted to him by KSEB previously. The Govt. order granting MD waiver to closed industrial units is not applicable to appellant since his factory was in service during the period in question. The plea to withdraw 25% extra charged in the bill for non-installation of TOD meter also find no merit and hence rejected. Since this is a long pending issue, time is extended to avail the benefit granted to the consumer by the Board. Ordered accordingly.

The appellant’s institution was being billed under non-domestic tariff and the anomaly regarding tariff fixation has been detected during the inspection conducted by KSEB officials. The tariff was revised as commercial which is applicable to self-financial institutions and an arrear bill issued towards the differential rate of charges between the old and new tariff. The petition disposed of with direction to keep pending the short assessment bill issued till the decision of SLPs pending before Hon. Supreme Court on similar subject.

The meter reading of the consumer was not taken continuously for 4 bi-months, citing the reason as door locked. Consumer was billed for the average reading as per previous consumption. Thereafter the meter reading shows high consumption during the disputed period and bill was prepared as per the energy consumption recorded after deducting the amount already remitted. Allowed the petition and quashed the disputed current charge bill.
