Tariff misuse, unauthorized additional load and extension of electric supply – booked under Sec.135 of Ele. Act, 2003- P/360/2013 –C.S. Kamalasanan, Kottarakkara.
On the basis of an inspection by KSEB, the consumer was issued with penal bill for tariff misuse, unauthorized additional load and unauthorized extension of supply and booked under Sec.135 of Ele. Act, 2003. The supply was disconnected under Sec. 135 and bill issued under Section 126 of Electricity Act 2003. It is found that the respondent has exceeded their powers in booking the case under Section 135 of the Act, and raising the bill for the offence of unauthorized use of electricity. The case has been remanded to the Assessing Officer to review the same and decide afresh as per law, as it is not maintainable before the Forum.
