The APTS of KSEBL conducted inspection in the premises of the appellant and detected that the Multiplication Factor (M.F.) used for arriving at the actual consumption was ‘20’ instead of ‘40’. In order to compensate the revenue loss sustained to the Licensees, a short assessment bill amounting to Rs.4,40,272/- was issued to the appellant and the appellant remitted Rs.30,000/-. The appellant approached CGRF, Southern Region, with a petition for the exemption from remitting the balance amount and of the amount already remitted and the Forum issued order as follows: (1) The respondent is directed to revise the short assessment bill of Rs.4,40,272/- dated 06-01-2021 by limiting a period of twenty-four months and to allow 12 monthly instalments to the petitioner without interest for the remittance of the amount, if the petitioner desires. (2) The respondent is also directed to arrange proper inspection in the premises of all the consumers having meters connected with CT/PT units and ensure the correctness of the multiplication factor, CT connection etc. The appellant filed this instant appeal petition before this Authority. A writ petition is filed by the respondent for KSEB Ltd. before the Hon’ble High Court of Kerala vide WP (C) No.26255 of 2021 against the order dated 02-09-2021 issued by Consumer Grievance Redressal Forum, Southern Region in OP No. 38/2021 and hence, the request of the appellant for the exemption from remitting the short-assessment bill is subject to the judgement of the Hon’ble High Court of Kerala in the said writ petition. The appeal petition filed by the appellant is disposed of accordingly.

In order to compensate the revenue loss sustained to the Licensee, a short assessment bill amounting to Rs.6,45,798/- was issued to the appellant. The appellant approached CGRF, Southern Region with a petition for the cancellation of the bill amount. The Forum issued order as follows: (1) The short-assessment bill for Rs.6,45,798/- is quashed. (2) The respondent is directed to revise the short assessment bill by limiting a period of twenty-four months without any interest and to allow suitable installments to the petitioner for making payment, if the petitioner desires. The appellant filed appeal petition before this Authority. The appeal petition referred to the wrong multiplication factor used by the Licensee for computing the actual energy consumption in the premises and thereby a short-assessment bill was issued to the appellant. The appellant wants to cancel the bill amount and not ready to remit the amount even for 24 months. A writ petition is filed by the respondent for KSEB Ltd. before the Hon’ble High Court of Kerala order of CGRF and hence, the request of the appellant for the exemption from remitting the short-assessment bill is subject to the judgement of the Hon’ble High Court of Kerala in the said writ petition. The appeal petition filed by the appellant is disposed of accordingly.

The appellant’s institution is a Self-Financing Educational Institution. Following the judgement of Hon'ble Supreme Court of India in Civil Appeal No. 8350 of 2009 filed by KSEB Ltd. pertains to the tariff category, the appellant was given a short-assessment bill for Rs.4,84,731/- (Energy charge Rs.1,51,242/- + Surcharge Rs.3,33,489/-) on 22-01-2021 being the difference in tariff between LT VIA and LT VIIA for the period from 09/2008 to 06/2010. The appellant approached CGRF for the exemption of surcharge from the electricity bill and the Forum in its order dismissed the petition allowing 12 monthly instalments. The appellant filed this appeal petition before this Authority. Since the appellant was given the short assessment bill as per the judgement of Hon’ble Supreme Court of India and for the reasons detailed above, the appeal petition No. P062/2021 filed by the appellant stands dismissed. The order dated 25-08-2021 in OP No. 145/2020-21 of CGRF, Northern Region is upheld.
