Based on an inspection conducted by the officials of KSEB, the consumer was issued with a short assessment bill for the unauthorized additional load detected in the premises. It is held that the appeal petition is not maintainable before the Ombudsman since it was charged under Section 126, unauthorised use of electricity. It is found that the penal bill raised by the respondent is against the method ordered by the KSERC and hence the case remanded to the assessing officer to review the same.

The appellant was penalized under Section 126 of Electricity Act, 2003 for unauthorized additional load which was detected during the APTS inspection. The appellant had already paid the estimated cost for installing a transformer for obtaining additional load in his premises. It is held that the appeal petition is not maintainable before the Ombudsman since it was charged under Section 126, unauthorised use of electricity. It is found that the penal bill raised by the respondent is against the method ordered by the KSERC and hence the case remanded to the assessing officer to review the same as per rules.

KSEB has collected the estimated cost for giving power to the appellant, including the Transmission cost (shared cost) of installing a 12.5 MVA transformer at the Sub station, for his multi-storeyed building. But KSEB has provided the electric supply without installing the new transformer as proposed and for which the amount was collected by sharing the total cost of transformer from 5 applicants. It is held that, collection of the cost of Transformer is not justifiable here, as the Board has released power without installing any Transformer as proposed.
