KSEB detected unauthorized load in the premises of the consumer and served a provisional bill under Section 126 of Electricity Act 2003. The consumer filed objection against the penal bill, before the AE wherein the consumer had stated that he had applied well in advance, for permanent additional load along with conversion from single phase to three phase supply. Since the petition is found not maintainable before this Forum, the case is remanded to the AE for arranging a fresh hearing with the observations of the Ombudsman.

The appellant has requested load enhancement and the AE returned the request with direction to submit with ‘completion report through a licensed wiring contractor. The consumer did not take any further action as directed by the AE for next 5 months. Meanwhile, KSEB inspected the premises of the consumer and detected unauthorized additional load. The consumer has remitted the penal bill issued to him in this regard. Thereafter the KSEB announced a Voluntary Disclosure Scheme to regularize the unauthorized load of the consumers of the State. The consumer demands refund of the penalized amount since he had disclosed the additional load earlier and thereby claims the benefit of the Scheme. The petition dismissed as it is found devoid of merits.

The APTS inspection revealed that one phase supply to the meter is not recording correctly. The consumer was issued a bill assessing the energy lost on this account. The appellant contest that the Mahazar prepared is at the office and the Meter was not sent for testing and adjudication by the Electrical Inspector and the 3rd member of CGRF has expressed a different note than that expressed by the others of the CGRF etc.
