KSEB officials detected unauthorized use of electricity by diverting the supply from the domestic connection to commercial connection, using change over switches. The consumer was issued penal bills for the irregularity. Since the consumption of both does not show any abnormal rise in domestic consumption with corresponding decrease in commercial connection during the disputed period, it is decided to set aside the disputed bill.

The KSEB officials inspected the premises of an Old age home as using for the stay of the staff of a Construction Company. The consumer was charged for misuse of tariff. A provisional assessment bill was issued. The appellant has the claim that, since the building is rented out for residential purpose, the domestic tariff is applicable. This Forum ruled that stay of a certain number of employees of a construction company in a building, can only be considered as private hostel or as a lodging facility.

The AE, KSEB has assigned LT VIIA tariff to the consumer, since it was found the major portion of the activities in the premises comes under commercial purpose. For multipurpose use of electricity from the electric connection or combination usage in a premise, the highest of the eligible tariff is applicable. Hence the petition dismissed.
