The main dispute is on tariff used for raising a penal bill for the offence of extending LT power supply from one HT premise to another and connecting unauthorized additional load there, under Section 126 of IE Act 2003. As any dispute or complaints pertaining to such matters are not maintainable before the CGRF and Ombudsman, the only point considered is whether the applicable tariff used for raising the penal bill, for the offence of unauthorized extension of service from one premise to another was in order. The applicable tariff for penalization must be the purpose for which energy was misused.

The KSEB has issued an exorbitant bill of 2864 units, for one month, to the domestic consumer. The consumer was not satisfied on the test done by installing a parallel meter by the KSEB at his premise and also disputed the test result of the meter test conducted by the Electrical Inspector. Held the average energy consumption for the disputed month as 500 units instead of 2864 units.
Failure to regularise UAL availed by the consumer and the short assessment bill issued to realize the proportionate current charges – P/231/2011 – Muhammed Kunju T., Ernakulam.

KSEB officials detected unauthorised additional load in the premises of the consumer and the consumer remitted the penal bill issued by the Board. Thereafter the consumer was served with another short assessment bill for the subsequent period as it was omitted to collect from him earlier. This Authority came to a conclusion that the disputed bill is maintainable and liable to be paid by the consumer.
