The appellant is a consumer under the Electrical Sub Division, Kottarakkara (West). Her grievance is with regard to the delay in shifting of an electric post which causes hindrance for vehicular traffic. Though the appellant paid the estimated work deposit amount, the KSEB could not complete the post shifting work due to the objection of a neighbour. The appellant already obtained no objection certificate from the Panchayath for shifting the electric post. The appellant approached the CGRF praying to direct the KSEB to take necessary steps to shift the electric post. The respondent submitted before the Forum that the Hon’ble Munsiff Court, Kottarakkara had passed interim order in OS 587/12 and 387/12 restraining the defendants from altering the lie and condition of the pathway. Moreover, the Neduvathoor Grama Panchayath sent a letter to the Assistant Engineer not to implement their earlier decision to shift the post in view of the injunction order of the Munsiff Court. In the circumstances the Forum closed the matter without granting the relief sought for. Aggrieved against the said order, this appeal petition was filed. Since the case pending before the Munsiff Court, Kottarakkara has not yet been disposed of, this Authority is not in a position to take a decision in the matter. Hence the appeal is disposed.

The appellant is the Secretary of Medical Mission Hospital, Kolencherry with consumer Nos. 8627 and 9093 under Electrical Section, Kolencherry. On 02/07/2013, two additional bills amounting to Rs. 1,96,008/- and Rs. 2,68,576/- were issued to the appellant on the ground of wrong classification of tariff during the period from 12/07 to 12/12. Against the said short assessment bills, the appellant filed complaint before the CGRF on 22/01/2014. The Forum held that the short assessment bills for Rs. 1,96,008/- and Rs. 2,68,576/- were in order. Aggrieved against the said order, this appeal petition was filed. Appeal Petition dismissed.

The appellant is having consumer no. 15380 under LT VII tariff. A bill for Rs. 94,900/- was issued to the appellant after inspection conducted by the APTS Thiruvananthapuram on 14/02/2014. It is alleged that the appellant extended the supply to a nearby building. The appellant filed a complaint before the CGRF stating that the bill issued by the Assistant Engineer was in wrong tariff. According to the respondent the matter of the complaint is an assessment under Section 126 of the Act and the CGRF is barred from entertaining such complaints in view of 21 (f) (vii) (I) of the KSERC (CGRF & Electricity Ombudsman) Regulations, 2005 and the Forum held that it was improper to entertain the complaint. Aggrieved against this order this appeal petition was filed. Appeal Petition is rejected as not maintainable.
