On the basis of an inspection by KSEB, the consumer was issued with penal bill for tariff misuse, unauthorized additional load and unauthorized extension of supply and booked under Sec.135 of Ele. Act, 2003. The supply was disconnected under Sec. 135 and bill issued under Section 126 of Electricity Act 2003. It is found that the respondent has exceeded their powers in booking the case under Section 135 of the Act, and raising the bill for the offence of unauthorized use of electricity. The case has been remanded to the Assessing Officer to review the same and decide afresh as per law, as it is not maintainable before the Forum.

The appellant was an employee and occupier of the Licensee’s company quarters. The appellant has not vacated the quarters after his retirement and the company disconnected the power supply to the quarters as per the request of its registered consumer. It is held that the appellant is eligible for reconnection with in 24 hrs and the respondent is ordered to pay compensation for illegal disconnection of electric supply.
Adding costs of Transformer at the Substation demanded by the Licensee for getting supply to the multi-storeyed building – P/317/2012 – T.S.Asok, Thiruvanathapuram.

KSEB has collected the estimated cost for giving power to the appellant, including the Transmission cost (shared cost) of installing a 12.5 MVA transformer at the Sub station, for his multi-storeyed building. But KSEB has provided the electric supply without installing the new transformer as proposed and for which the amount was collected by sharing the total cost of transformer from 5 applicants. It is held that, collection of the cost of Transformer is not justifiable here, as the Board has released power without installing any Transformer as proposed.
